An administrator pendente lite is not empowered to make distributions or advancements of the estate under s.34 Trustee Ordinance while probate challenges are pending; s.40(2) PAO expressly prohibits distribution by an administrator pendente lite and any court directions under s.40(3) must be subject to that prohibition, therefore the requested payment cannot be ordered and the appeal must be dismissed.
