The plaintiff breached the account order and failed to provide a proper verified account and disclosure; accordingly the court was entitled to draw adverse inferences, rely on expert evidence and apply a reasonable approximation to determine benefits attributable to Xinrui. Applying these principles, accepting much of SAIF's expert evidence and assumptions against Zhou, the Master found liability on six claimed heads (excluding share options) and ordered Zhou to pay US$5,933,253.31 plus interest and costs.
