The court found beyond reasonable doubt that the 1st Defendant wilfully failed to file the required affirmation under paragraphs 4 and 5 of the Amended Order and Judgment and that the 2nd Defendant, as sole director, knew the terms of the order, could have used his position to secure compliance and failed to do so; both defendants were therefore in contempt. The 2nd Defendant was sentenced to 3 months' imprisonment; leave was granted to issue a writ of sequestration against the 1st Defendant; costs awarded to the Plaintiff on an indemnity basis.
