By majority the Court of Appeal upheld the High Court: where the sworn information, on a plain reading, does not disclose reason to believe that documents in the premises would contain evidence of an offence under s9(1)(a) POBO, the magistrate lacked jurisdiction under s10B ICAC Ordinance to issue the search warrant; courts will not permit strained semantic constructions to convert allegations of dishonest acts into corrupt transactions with the firm's principal for the purposes of s9(1)(a).
