The Court held that D2's admitted acts (introducing applicants with promises of free first-year premiums), his status as a registered insurance agent and sub-agent, and the surrounding evidence justified the inference that he knew issuance of the policies would lead New York Life to pay commissions; therefore conviction was upheld. However, because D2's participation and financial benefit were materially smaller than other conspirators, his sentence was reduced from 30 months to 24 months imprisonment.
