The statutory demand was valid and not complied with; the petitioner was entitled to recover the amount claimed under the service agreement; the debtor's withdrawal of opposition left no defence to the petition, therefore a bankruptcy order should be made with costs.

The court found the defendant procured clients (Basel clients, 18 TDC clients and Argo) to breach or terminate their contracts and disclosed plaintiff's trade secrets; the 3/5/01 written agreement did not entitle the defendant to commissions on executory contracts beyond 30/4/01 and parol evidence could not alter that; damages were assessed on lost commissions and profits plus nominal damages for breach of confidence, and the defendant's counterclaim was dismissed.
