On the assumed facts the defendants succeeded because the Privy Council\'s decision in Lam Island permits the 20 year limitation period for adverse possession to straddle 1 July 1973, entitling the defendants to succeed on their limitation defence; alternatively the defendants established arguable defences (part performance of the 1969 transfer and aggregation of successive possession) sufficient to justify setting aside the default judgments and proceeding to trial.
