There was no relationship of dominance or control giving rise to a presumption of undue influence; even if a presumption were assumed hypothetically, the evidence did not justify an inference that the transaction was procured by undue influence or abuse; defendants had been warned, acknowledged unlimited liability and declined independent legal advice, therefore the charge and judgment for the bank stand.
