The application for security for costs failed because the respondents did not establish special circumstances: evidence that the appellant held a 9/16 interest in mainland property negated a finding of impecuniosity or non‑residence, and the weakness or poor drafting of the notice of appeal by an unrepresented appellant did not constitute abuse of process; accordingly no security was ordered and no costs order was made on the application.
