Leave to appeal refused because the Court of Appeal was plainly entitled to conclude that the documents proffered could not establish that the Opening-up Scheme was a pretext or that the earlier judgment had been procured by fraud without cross-examination and oral evidence; accordingly there was no proper foundation for reopening the appeal and the lower court's exercise of discretion, including on costs, was proper.
