Leave to appeal was granted because the questions of whether the indictment should have been amended to provide alternative counts and whether the judge's all‑or‑nothing jury direction improperly deprived the jury of other verdicts raised arguable questions of law warranting determination by the Court of Final Appeal; leave was also granted to argue that the directions caused substantial and grave injustice.
