Because the mortgage loan became repayable on 5 October 1972 and there was no evidence of written acknowledgement or payment of capital or interest within the 20‑year period under section 19 Limitation Ordinance, the mortgagee's right to recover was time‑barred; accordingly the court, applying authorities, declared the 6 April 1972 mortgage no longer subsisting or capable of taking effect between vendor and purchaser under section 12 CPO.
