The court accepted that the Tribunal majority was correct that the 1981 amnesty letter gave rise to a legitimate expectation which should have been considered by the decision-maker and that failure to take it into account amounted to an abuse of power; notwithstanding that finding, the court exercised its discretion to refuse the relief sought because the matter was academic, the Tribunal was prepared to rehear the matter and no substantial prejudice would result from refusing relief.
