The Court of Appeal held the right of way granted in 1970 includes an ancillary right to stop vehicles on the Road for the purposes of loading and unloading goods and for picking up and setting down passengers where such stopping is reasonably necessary for the comfortable and convenient enjoyment of the easement; accordingly a permanent injunction was granted to protect that ancillary right.
