Section 64(3) does not force an exclusive election barring judicial review of an administrative authority's decision where an objection has been lodged with the Chief Executive; rather, s64(3) protects decisions of the Chief Executive in Council from judicial review only insofar as those decisions fall within the statutory 'permitted field' and are not nullities. Where the Chief Executive in Council acts outside jurisdiction, in bad faith, or in a manner that renders its decision a nullity, judicial review remains available under Anisminic and its authorities.
