The defendant failed to discharge the burden of proving genuine use of the Registered Mark in Hong Kong during the relevant three year period. The catalogue and undated photographs were insufficient, unsupported and not shown to have been made available to customers or to evidence sales or marketing in Hong Kong. Accordingly the registration was revoked under s52(2)(a) and the defendant's rights are deemed to have ceased from 29 November 2013.
