The Court held the trial judge did not err in preferring the evidence of the police witness over the taxi driver and the accused, his reasons for finding the taxi driver's memory unreliable were permissible, the use of the phrase 'I prefer' did not indicate a departure from the burden of proof, and therefore the conviction was not unsafe; appeal dismissed.
