The court declined to vary the costs order nisi except to direct that the respondent's own costs up to 5 September 2022 be taxed under the Legal Aid Regulations and ordered the applicant to pay the respondent's costs of the assessment (including this application) to be taxed if not agreed, because alleged improper conduct was not raised or tested at trial, the respondent had already been sanctioned for earlier discovery non-compliance and costs should generally follow the event.
