    Court
    Court of Appeal
    Case number
    CACC266/2005

The Court held s83A(2) is valid and its exercise to substitute convictions for manslaughter and impose appropriate sentences does not breach Art 11(4); on the psychiatric evidence the appellant suffered drug-induced psychosis amounting to diminished responsibility but represents a long-term danger warranting concurrent life sentences on each manslaughter count with a specified minimum term of 16 years; sentences on other counts remain concurrent and unaffected.
