The Court dismissed the application because established authority (HL v. MTC) holds that a refusal of leave is not appealable to the Court of Final Appeal and, in any event, none of the conditions in section 22(1) of the Court of Final Appeal Ordinance were satisfied; therefore no appeal to the Court of Final Appeal could lie and the application for leave was dismissed.
