The magistrate made a proper assessment of the prosecution evidence, accepted PW1 as an honest and reliable witness whose testimony that the identity card fell from the appellant's rear pocket within close proximity supported the charge; there was no basis for appellate interference, so the conviction stands.

Although the sentence of two years was on the high side, having regard to the facts — substantial value of goods, the defendant's recklessness in ordering goods he was unlikely to pay for, and his personal circumstances — the sentence was not so high that the Court should interfere; the application for leave to appeal against sentence is refused.
