Given the quantity of almost 1,000 grams (well above the 600 gram cut-off), the organised international element, meticulous planning and risk to tour members, the court held the 21-year starting point and the reduced sentence of 14 years were not manifestly excessive and declined to interfere.

The court held the magistrate was entitled to depart from the Eagle Eye guideline because the facts involved open, blatant sale of counterfeit watches of famous brands; the experienced magistrate could rely on his knowledge of the prevalence of the trade and the need for deterrent fines; the fines, though severe, were not manifestly excessive and did not merit appellate intervention, therefore the sentences were affirmed.
