A pension payable by the Crown cannot be attached under Order 49 or Order 77 because s23(1) Crown Proceedings Ordinance does not apply to cases where the payee owes money to the Crown; however the Attorney-General may rely on Section 12 of the Pensions Ordinance to protect Crown debts and, where procedure is absent, the court may mould an appropriate procedure (modelled on Order 49) to effect attachment in satisfaction of a debt due to the Crown.
