Pursuant to s.73A read with s.9 Criminal Procedure Ordinance and Order 62 of the Rules of the Supreme Court, the Hong Kong High Court should follow the English practice direction: normally award costs to acquitted defendants out of public funds unless positive reasons exist not to; applying that test, the court awarded costs to Ng Yui-kin, Ho Yim-pun and John Coull, to be fixed by the Registrar.
