Applying Payne v Payne principles as endorsed in SMM v TWM, the court found the mother's application genuine and realistic, the father's abuse allegations unproven or estopped by prior findings, and that relocation to Canada is overall in the children's best interests; accordingly leave to remove was granted subject to detailed access, supervision and undertakings to preserve the father's relationship with the children.
