A person suspected of a criminal offence is not a party to an ex parte originating application made under section 77E and therefore has no automatic right under O.63 r.4(2) to inspect documents filed in the Registry in respect of that ex parte application; the Master's broad order granting leave to inspect was an improper exercise of discretion and must be set aside, though the suspected person retains the right to inspect the originating application itself under O.63 r.4(1)(a) and any order made in open court under O.63 r.4(1)(b).
