For purposes of the Ordinance the relevant date is the date of the offence alleged against the applicant; the 4th accused was charged only on count 3 which alleged conduct before the Ordinance commenced, section 25 therefore excludes section 17 from applying to him; the Ordinance does not have retrospective effect and English Practice Directions cannot supply a statutory power to award costs absent domestic legislation; accordingly the application for costs fails.
