The court held that 'purchaser' in Special Condition (1) did not include the plaintiff as a successor in title, so the plaintiff was not obliged to obtain prior governmental consent and therefore possessed a good title at the time of rescission; alternatively, even if the plaintiff had breached any consent requirement the breach was of minimal significance and did not render the title defeasible, so the plaintiff's notice to complete and rescission were valid and the plaintiff's summonses must be allowed.
