The magistrate's factual findings that the appellant deliberately kissed and touched the complainant and that the conduct, taken as a whole, was indecent were not shown to be unsafe on appeal; however the appellate court found the custodial sentence excessive in the circumstances and substituted a fine of HKD 10,000 with a default 14 days' imprisonment.
