The 2nd Summons was dismissed as an abuse of process because it sought substantially the same relief as the 1st Summons adjourned by consent and the handing down of the partial cost award did not constitute a material change of circumstances since the plaintiff was aware that the arbitrator had reserved the right to continue and proceed with the arbitration.
