The NPCSC interpretation under Article 158 is binding on HKSAR courts; under Articles 13(1) and 19(3) the CPG may determine uniform PRC rules on state immunity which HKSAR courts must apply, resulting in the adoption of absolute state immunity for the purposes of this case and a finding that the DRC did not waive immunity.
