Leave to appeal was refused because, on the facts of an extreme, malicious and bad‑faith campaign of scurrilous abuse and targeted intimidation of a judge which was calculated to and posed a real and substantial risk of undermining public confidence in the administration of justice, the common law offence of scandalising the court was lawfully applied and the 4‑month sentence did not amount to a substantial and grave injustice.
