Leave to apply for judicial review was properly refused because the applicant failed to identify any reasonably arguable error of law, procedural unfairness or irrationality in the Director's or Board's decisions; the Board's adverse credibility findings and conclusion that internal relocation was viable meant there was no real prospect of success.

The appeal was dismissed because the applicant failed to identify any reasonably arguable legal error by the Deputy Judge or the Board with sufficient particularity, having adductions rejected by the Board as inherently unreliable; credibility and factual evaluation were properly within the Board's remit and the Deputy Judge correctly refused leave and extension of time.

The court held that an indeterminate sentence without a minimum term does not, by itself, constitute cruel, inhuman, degrading or arbitrary treatment contrary to art.3 of the Bill of Rights or art.28 of the Basic Law; the statutory Review Board and impending legislation provide lawful mechanisms to address uncertainty; habeas corpus cannot be extended to require the court to assess or impose a minimum term or to convert complaints about conditions of lawful detention into grounds for immediate release. Accordingly the habeas corpus application was refused.
