The court held that the nature of the offence charged (conspiracy to publish seditious publications under Crimes Ordinance s10(1)(c))—as defined by s9 and s10 and in light of Basic Law 23 and NSL Article 7—and the CFA's authoritative determination in HKSAR v Ng Hau Yi Sidney that such offences qualify as offences endangering national security, necessarily engages NSL Article 44(3). Therefore all proceedings relating to the prosecution must be handled by designated judges in the District Court.
