The magistrate properly evaluated the evidence, accepted PW1 and PW2 as credible, found Exhibit P4 corroborative of the payment, rejected the appellant's alternative explanations as not credible or inherently improbable, and on that basis the prosecution proved the appellant obtained HK$40,000 by deception beyond reasonable doubt; the conviction is safe and the appeal is dismissed.
