The Court found the Magistrate's starting point for a persistent offender was appropriate but the additional 2 month reduction for admission of obscenity was inappropriate because that factor is subsumed within the guilty plea discount; accordingly the sentence was increased by 2 months to a total of 10 months imprisonment and the $20,000 fine was upheld.
