Article 6 of the Arrangement does not include cross‑examination in the conventional Hong Kong sense when the requesting party is the Hong Kong court; Article 7 cannot be invoked to expand Article 6; the statutory test for issuing a letter of request is necessity for the purposes of justice and the plaintiff failed to demonstrate necessity or the extent/value of any limited cross‑examination; accordingly the intended appeals had no reasonable prospect of success and leave was refused.
