Hearsay evidence relied on via the plaintiff's next friend was excluded or given no weight because exclusion was not prejudicial to justice and the plaintiff declined to give oral evidence; on the remaining admissible evidence the court found insufficient and unreliable proof that the plaintiff had been subjected to bullying as properly defined or that the two incidents were foreseeable consequences of any systemic failure by the School; the School's anti-bullying system complied with EDB guidance; therefore the defendants did not breach a duty of care and the plaintiff's claim is dismissed.
