Court accepted the joint orthopaedic expert's opinion and all relevant evidence, fixed permanent loss of earning capacity at 6%, adopted the applicant's monthly income of HK$14,300 (HK$550 x 26), and awarded HK$14,300 x 72 x 6% = HK$61,776 under s9 plus medical expenses HK$1,740 under s10A, ordering payment with interest and costs.

Having accepted the applicant's factual evidence and the uncontested expert medical report of Dr Lam, the court found respondent liable under the Employees Compensation Ordinance, increased the assessment of permanent loss of earning capacity to 3% attributable to the accident, and awarded statutory compensation calculated under sections 9, 10 and 10A minus prior payments, with interest and costs to the applicant.

Applicant discharged the onus of showing a reasonable excuse for delay: credible evidence of employer threats and a genuine unresolved conflict in medical evidence on causation made it inappropriate to decide causation without trial; on that basis and having regard to lack of forensic prejudice to respondent the court properly exercised its discretion to extend time under s.14(4), s.18(2) and s.16B(2) and granted leave to proceed with the applications.
