The court held that Leung Lim-man remains authoritative: for a conviction of assisting in management the court must sentence on that basis; there was no evidence that such offences had increased, the appellant was a first offender in respect of this conduct, her income indicated no large profit, and the premises were closed making reoffending unlikely. Therefore immediate custody was not warranted and the magistrate's custodial sentence was substituted with a suspended sentence.
