Leave to amend was granted. The court held that the proposed amendments were prima facie relevant and arguable, the Sino Polymer pleas were within the scope of the pleaded duties and could be probative as similar fact evidence, the contested passages from the Mainland judgments were not plainly impermissible as pleaded evidence, and the defendant failed to demonstrate amendment-specific prejudice or undue delay given the discovery timeline and case complexity. Accordingly the amendment application should succeed and costs were ordered on a nisi basis.
