The Judge rightly refused leave because the applicant failed to identify any reasonably arguable error of law, irrationality or procedural unfairness in the Board's decision; the Board considered the applicant's claim and correctly found that separation from her child did not amount to BOR 3 ill-treatment and the Human Rights Reports were inadmissible new evidence under Ladd v Marshall and would not affect the outcome; therefore no viable ground for judicial review was established and the appeal is dismissed.
