The court granted the s 21 disclosure because the plaintiff demonstrated a strong evidential basis that HK$200,000 was transferred to the 1st defendant's account, the information sought was specific and likely to assist in locating or preserving proprietary assets, and the balance of interests favoured disclosure given the Bank's neutral stance and prior orders for disclosure.

The court applied the relevance test under s.21 and, balancing privacy concerns and the need to trace misappropriated funds in a large-scale cyber fraud, ordered Standard Chartered Bank to produce records of Real Friendship Limited despite the account holder's deregistration and absence of service because the records were likely germane to issues and would assist tracing proceeds of the fraud.

The court held that, on the evidence and taking a pragmatic broad‑brush approach appropriate to a summary s221 application, bank account and loan records (paragraphs 1 and 2 of Schedule 1) for Designated Companies in categories 1, 2 and 3 do relate to the Companies and are reasonably required by the liquidators; records for category 4 (Grande group) are producible only to the extent they relate to the affairs of the Akai group; accordingly a production order and orders for oral examination were made, with approval of the revised draft order subject to specified deletions and qualifications.
