The Court ordered HSBC to produce specified account records for defined periods because there was a high likelihood the records exist, they are directly relevant and necessary to fairly dispose of the preliminary issue on beneficial ownership; BOC appeared to have purged older records and was ordered to file an affirmation confirming that position; procedural objections to applying to banks were rejected on these facts given disputed parties had deposed non-possession and the banks indicated willingness to comply.
