The Court of Appeal agreed with the judge below that the appellant failed to establish she was an 'aggrieved person' under s.83 because even if the proposed litigation succeeded there was no realistic prospect of surplus for the bankrupt after satisfying creditors; alternatively, even if she were aggrieved she failed to show the trustees' decision was irrational or perverse.
