The Court of Appeal held that the 5th applicant had a sufficient interest at the leave stage by virtue of his role as chairman and organiser and that the material disclosed an arguable case that the Director's decisions may have been intended to prevent Falun Dafa members attending the conference, thereby engaging Article 141; accordingly leave to apply for judicial review was granted and the 6th applicant properly joined; arguments about s11 and Articles 154/39 were arguable and to be determined at the substantive hearing.
