Leave to adduce Professor Zhang's expert evidence on appeal was refused because the appellant failed the first Ladd v Marshall condition (the evidence could have been obtained with reasonable diligence before trial), and the expert report in any event did not meet the second and third Ladd v Marshall conditions (it was not sufficiently relevant or credible to probably influence the result), such that the court would not exercise its discretion to admit it.
