Leave to apply for judicial review was refused because the proposed grounds were not reasonably arguable: the Policy permits case by case humanitarian assistance including in appropriate destitution cases; international conventions relied on are undomesticated; Articles 36 and 145 do not protect non-residents; the Policy is rationally based in distinguishing visitors from formal claimants and the applicants no longer have sufficient interest because they have received assistance.
