The Court dismissed the Notices of Motion and struck out the appeals as incompetent because finality provisions in the High Court Ordinance (s.14AB and s.14(5)) bar appeals from decisions refusing leave and from determinations whether a judgment is interlocutory; the Basic Law art.104 duty does not negate or override those finality provisions and there was no arguable breach by the judges in applying procedural law (including the effect of failure to pay security under s.73).
