The applications for leave to appeal were refused because (1) section 22(1)(a) HKCFAO does not apply to disgorgement assessments made by the Insider Dealing Tribunal since they are not liquidated sums or proprietary civil rights, and (2) the grounds advanced under section 22(1)(b) did not meet the high threshold of great general or public importance and included matters bound by precedent or plainly hopeless, so leave should be refused.
